Covenants, Conditions, and Restrictions (CC&Rs) describe the rights and obligations of each owner and those of the association itself. CC&Rs outline the boundaries of each unit or lot and those of the development's common area. They describe the maintenance responsibilities of each owner and those assumed by the HOA, the operating costs to the owners, and how they will be collected, and the rights and protections granted to mortgage holders.

Additionally, they lay out the HOA's powers of enforcement, procedures to resolve disputes, and the restrictions on owner usage, which might include regulations governing pets, how an owner alters the property, and the uses of the common area.


HOA bylaws, not to be confused with CC&Rs, describe the procedures and mechanics of HOA management and decision-making. This includes officer and director positions and how they are filled, the way meeting, voting, and notification are undertaken for owners' and board members' decisions, and the methods of record-keeping and reporting.

The social success of a condominium community depends, in large part, on the rules, regulations, and restrictions that govern how residents are expected to conduct themselves. Typically, the declaration subjects all homeowners to general covenants, while the bylaws and house rules and regulations provide specific guides for day to day living. Without these restrictions and a means to enforce them, the Community living experience could become chaotic indeed. Your Board of Directors has adopted the following "RULES AND REGULATIONS" to enhance the enjoyment and tranquility for all persons living in the community, as well as to aid in protecting and growing property value.

These Rules and Regulations do not supersede or change the Bylaws or CC&Rs in any manner. They do have the same status as law and enforceability.


Architectural standards (aka "architectural guidelines, "design standards," etc.) set forth an association's policies and procedures regulating a homeowner's ability to make architectural improvements and modifications to the homeowner's separate interest, as well as to common area and exclusive use common area. Architectural standards are operating rules which may impose additional architectural restrictions beyond those contained in an association's CC&Rs. An association's authority to establish and enforce architectural standards is premised upon the impact that aesthetics have on the property values of the association's members.


All leased or rented units must be on file with the HOA and include a copy of the Lease Agreement and the 'Leasing Form'. 

Justifying rental restrictions typically involves the maintenance of property values and the promotion of community standards. More renters within a development can result in higher liability insurance rates and lower property values. Likewise, rental restrictions can increase the number of residents with a vested interest in the development's long-term success, thereby promoting neighborhood stability and a sense of community. Because renters tend to be more likely to violate association rules and less likely to obey upkeep standards, promoting compliance with covenants is a legitimate purpose for rental restrictions.


One of the main functions of architectural standards in a community is to help maintain property values. The authority to regulate a homeowner's right to make improvements or modifications to their property derives from the governing documents. 

The architectural standards and guidelines are administered by the Modifications Committee, which is responsible not only for enforcing standards but reviewing members' applications for additions or modifications according to established procedural rules. Modifications requests must be accompanied by the 'Modification Form'.


The Board has the responsibility to enforce the provisions of the Declaration of Covenants, Conditions, and Restrictions, the Bylaws, the Design Guidelines, and the Cottages at Indian Park Rules and Regulations in order to preserve and enhance the appearance, appeal, and overall value of the Association property. One enforcement tool provided is the ability of the Association to levy fines for violations of the aforementioned documents. In an effort to create more protective measures and ensure fairness the following guidelines for common fines shall be used.
